தெஹிவளையில் பள்ளிவாசலை இடிக்கும், வழக்கு வாபஸ் - 10 வருட போராட்டம் வெற்றி

தெஹிவளையில் அமைந்துள்ள பாத்தியா மாவத்தை பள்ளிவாசலை இடிக்கும் உத்தரவைப் பெறுவதற்காக, கல்கிஸ்ஸை மாஜிஸ்திரேட் நீதிமன்றத்தில் தாக்கல் செய்த வழக்கை நகர மேம்பாட்டு ஆணையம் (UDA) வாபஸ் பெற்றது.

2014 ஆம் ஆண்டில், பாத்தியா மாவத்தை மசூதியின் இருப்பு குறித்து தீவிர பௌத்த அமைப்புகள்  உள்ளூர் பொலிஸ் நிலையத்தில் புகார்களை அளித்தனர்.

எனினும்  பதிவு ஆவணங்களை முறையாக சமர்ப்பித்ததன் மூலம், உள்ளூர் காவல்துறை மட்டத்தில் வழக்கு ரத்து செய்யப்பட்டது.

2015 ஆம் ஆண்டில், இன ரீதியாக தாக்கல் செய்த புகார்களின் அடிப்படையில், மசூதி வளாகத்தில் அங்கீகரிக்கப்படாத கட்டிடங்கள் இருப்பதைக் காரணம் காட்டி, கல்கிஸ்ஸை மாஜிஸ்திரேட் நீதிமன்றத்தில் வழக்குத் தொடர்ந்தது. 

தேவையான அனுமதிகள் இருப்பதாகக் கூறி பள்ளிவாசல் நம்பிக்கையாளர் சபை மேற்படி விண்ணப்பத்தை முறையாக எதிர்த்தனர். 

இருப்பினும், நம்பிக்கையாளர் சபையின் சார்பிலான வழக்கறிஞர்கள் எழுப்பிய ஆட்சேபனையின் பேரில், UDA நடவடிக்கையை வாபஸ் பெற வேண்டிய கட்டாயம் ஏற்பட்டது.

இதற்கிடையில், மேற்படி மசூதிக்கு ஏற்பட்ட துன்புறுத்தல்கள் குறித்து மனித உரிமைகள் ஆணையம் மற்றும் பிற சட்ட அமுலாக்க அதிகாரிகளிடம் பல புகார்கள் செய்யப்பட்டன.

அதைத் தொடர்ந்து, ஏப்ரல் 2019 இல், UDA மாஜிஸ்திரேட் நீதிமன்றத்தில் ஒரு புதிய வழக்கைத் தாக்கல் செய்தது, அதற்கு எதிராக பள்ளிவாசல் நம்பிக்கையாளர் சபை #மேல்முறையீட்டு நீதிமன்றத்தில் ஒரு ரிட் விண்ணப்பத்தைத் தாக்கல் செய்தனர்.

இந்த வழக்கை விசாரித்த மேல்முறையீட்டு நீதிமன்றம், UDA-க்கு எதிராக ஒரு தடை உத்தரவைப் பிறப்பித்தது, மேலும் அசல் வழக்குப் பதிவை #மாஜிஸ்திரேட் நீதிமன்றத்திடமிருந்து கோரியது.

இந்த இரண்டு சட்ட மன்றங்களிலும் இந்த வழக்கு வாதிடப்பட்டபோது, ​​சர்ச்சையை இணக்கமாகத் தீர்க்க பள்ளிவாசல் நிருவாகிகள் UDA-வுடன் கலந்துரையாடலில் ஈடுபட்டிருந்தனர். 

நடைபெற்ற விவாதங்களின் விளைவாக, பள்ளிவாசல் நிருவாகிகள் மசூதியின் நிலத் திறனை அதிகரித்து, UDA-வின் திருப்திக்கு ஏற்ப மேலும் இணக்கப் பணிகளை மேற்கொண்டனர். 

இதன் விளைவாக, 2024 ஆம் ஆண்டின் பிற்பகுதியில், UDA பள்ளிவாசல் நிருவாகிகளுக்கு ஒரு புதிய கட்டிட மேம்பாட்டு அனுமதியை வழங்கியது.

அதன்படி, இன்று முன்னதாக, UDA இந்த முன்னேற்றங்களை நீதிபதியிடம் தெரிவித்து நடவடிக்கையை #வாபஸ் பெற்றதன் மூலம் சுமார் 10 வருடகால சட்டப் போராட்டம் நிறைவுக்கு வந்தது.

இந்த மசூதி #தாக்கப்பட்ட ஒவ்வொரு சந்தர்ப்பத்திலும் மூத்த வழக்கறிஞர் #ஷிராஸ் நூர்தீன் நீதிக்காக இடைவிடாமல் குரல் கொடுத்தார் என்பது குறிப்பிடத்தக்கது. 

அவருக்கு முதலில் வழக்கறிஞர்கள் #ருஷ்டி ஹபீப், #ஷஃப்ராஸ் ஹம்சா, #மகேஷ் பெருகோடா மற்றும் #மைத்ரி குணரத்ன பி.சி ஆகியோர் உதவினார்கள். பின்னர், மாஜிஸ்திரேட் நீதிமன்றம் மற்றும் யுடிஏவில் நிவாகிகள் பிரதிநிதித்துவப்படுத்திய வழக்கறிஞர் திரு. #பசன் வீரசிங்க. 

பள்ளிவாசல் நிருவாகிகள் சார்பாக மேல்முறையீட்டு நீதிமன்றத்தில் #பசன் வீரசிங்க, #அஞ்சனா ரத்னசிறி மற்றும் ஜனாதிபதி வழக்கறிஞர் #சாலியா பீரிஸ் ஆகியோர் பிரதிநிதித்துவப்படுத்தினர்.

நீதிக்காக உறுதியாக நின்று இந்தப் பிரச்சினையை இணக்கமாக தீர்க்க கடுமையாக உழைத்த இந்தப் பள்ளிவாசலின் #நிருவாகிகள் நாடு முழுவதும் உள்ள மசூதி நிருவாகிகளுக்கு ஒரு நல்ல முன்னுதாரணமாக அமைகிறது.

10 year long Legal Battle with UDA on closure of Mosque at Dehiwala comes to an end!

Earlier today, the Urban Development Authority withdrew the case they had filed before the Magistrates Court of Mount Lavinia to obtain a demolition order against Bathiya Mawatha Mosque situated at Dehiwala. 

In 2014, Ultra Buddhist forces lodged complaints with the local police against the existence of the Bathiya Mawatha mosque and with due submission of Registration Documents, the case was nullified at the local police level. 

In 2015, the UDA based on complaints filed by the said racially motivated elements, had filed an action before the Magistrate’s Court of Mount Lavinia citing the the existence of unauthorized constructions of buildings in the mosque premises. The Trustees had duly opposed the said application stating the existence of necessary permits. However, upon a technical objection raised by the Lawyers of the Trustees, the UDA was compelled to withdraw the action. 

In-between, many complaint were made to the Human Rights Commission and other law enforcement authorities for the harassment meted to the said Mosque.

Subsequently, the UDA had filed a fresh action before the Magistrate’s Court in April 2019 against which the Trustees had institute a Writ Application before the Court of Appeal. 

The Court of Appeal having heard the matter, had issued a Stay Order against the UDA and had further called for the original case record from the Magistrate’s Court.  

While the matter was being contended before these two forums of Law, the Trustees had engaged in discussion with the UDA to amicably resolve the dispute. As a result of the discussions held, the Trustees had increased land capacity of the mosque and carried out further compliance work to the satisfaction of the UDA. As a result of which, in the latter part of 2024, the UDA had issued a fresh building development permit to the Trustees. 

As such earlier today, the UDA informed these developments to the Magistrate and withdrew the action, drawing an end to a prolonged legal battle. 

It is notable that senior attorney Mr. Shiraz Noordeen relentlessly stood for justice on every indtance this mosque was under attack. He was initialy aidded by Attorneys Rusdhie Habeeb, Shafraz Hamza, Mahesh Berugoda and Maithri Gunaratne PC. Subsequently Mr. Pasan Weerasinghe, Attorneys-at-Law represented the trustees in the Magistrate’s Court and the UDA. 

Many in political leadership made attempts to resove this issue through amicable settlement, notable mentions to former Ministers Fawzi and Prassanna Ranathuga.

The Trustees were also represented in the Court of Appeal by Pasan Weerasinghe, Anjana Rathnasiri and led by President’s Counsel Saliya Peries.

Trustees of this mosque who stood firmly for justice and worked hard to amicably resolve this issue leaves a good bench mark for mosques trustees across the country.
