இயக்க பகைகளை மனதில்வைத்து ஷரீஆ சட்டத்ததை விமர்சிப்பதும், சவூதியின் கடமைகளும்..!

சஊதி அரேபியாவின் ஷரீயா சட்டம் கடுமையான விமர்சனத்துக்குள்ளாகியுள்ள நிலையில், நமது சில முஸ்லிம் ஆசாமிகளும் சில இயக்க பகைகளை மனதில் வைத்துக்கொண்டு விமர்சிப்பது வேதனைக்குரியது. முதலில் சஊதி அரேபியாவுக்கு பணிப்பெண்ணாக செல்பவர்கள் SLBFE யின் ஊடாக சஊதி யின் சட்ட திட்டங்களுக்கு அமைய அங்கே செயற்படுவேன் என்ற உடன்படிக்கைக்கு இணங்கியே செல்கின்றனர். சஊதி சட்டம் கடமையானது என உணர்ந்தால், ஒன்று பணியாளர்கள் செல்லாமல் இருக்க வேண்டும், அல்லது இலங்கை அரசாங்கம் அதை தடை செய்ய வேண்டும் அல்லது சஊதி தவிர்ந்த வேறு முஸ்லிம் நாடுகளுக்கு செல்ல வேண்டும். அதை விடுத்து வீணாக சில அரசியல் நோக்கங்குளுக்ககவும், இயக்க பகைகளை மனதில் வைத்துக்கொண்டு விமர்சிப்பது இதற்கு தீர்வல்ல.

உதாரணமாக, சிங்கப்பூரில் போதைப்பொருள் கொண்டு செல்பவருக்கு மரண தண்டனை விதிக்கப்படும் என்பது அந்நாட்டு விதி. அதே நேரம் இலங்கையில் ஆயுள் தண்டனை அல்லது நான்கு வருடங்களின் பின் நாடு கடத்தப்படுவர். இலங்கையை சேர்ந்த ஒருவர் போதைப்பொருளுடன் சிங்கப்பூரில் பிடிபட்டால், அவருக்கு அங்கே மரண தண்டனை வழங்கப்படுவதை நாம் விமர்சிக்க முடியாது, ஏனென்றால் அது அவர்களின் நாட்டு சட்டம். அவர்களின் இறையாண்மையில் நாம் தலையிட முடியாது. இதே நிலைதான் சஊதி விடையத்திலும். எத்தனையோ அந்நிய மதத்தவர்கள் கூட எந்த பிரச்சினையும் இல்லாமல் சென்று பணி புரிந்து வருகிறார்கள். விமர்சனத்துக்கு உள்ளாகியுள்ள இந்த கொழும்பை சேர்ந்த நபர் நான்கு முறை தனது குற்றத்தை ஒப்புக்கொண்டுள்ளார். எனவே குற்றத்தை ஒப்புக்கொண்டவருக்கு குற்றவாளி என்ற ரீதியில் அந்நாட்டு சட்டப்படி தண்டனை வழங்குவதை விமர்சிக்கும் உரிமை எமக்கு இல்லை, மாறாக சஊதி அரசாங்கத்திடம் குர்ரவாள்ளியின் நிலையை விளக்கி அரசாங்கம் மூலம் தண்டனை குறைப்புக்கு விண்ணப்பிக்கலாம்.
மேலும், விபச்சாரத்தை தூண்டக்கூடிய சூழ்நிலை இல்லாத சூழ்நிலையிலேயே தண்டனைகள் வழங்கப்பட வேண்டும். மற்றைய இஸ்லாமிய நாடுகளை போலல்லாது, சஊதியில் இந்த இஸ்லாமிய சூழல் காணப்படுகிறது. இதை தகர்த்து, ஜனநாயகம், உரிமை என்ற பெயரில் மக்கா, மதீனா புனிதச்தலங்க்களை சகல இன மக்களையும் அனுமதிப்பதன் மூலம், ஒரு சுற்றுலா பிரதேசம் போல் ஆக்க வேண்டும் என்பதே சர்வதேச சூழ்ச்சியாளர்களின் சதி. ஒருவர் இஹ்ராம் உடுத்துக்கொண்டு ஹஜ், உம்ரா செய்ய , தூய எண்ணத்துடன் சஊதி விமான நிலையத்தில் இறங்கியதும், குட்டை பாவாடையுடனும், மேற்கத்திய ஆடைகளுடனும் எங்கும் உலாவுவதை கண்டால், அவரின் புனித பயண என்னத்துக்கு அது எப்படி இடைஞ்சலாக இருக்கும் என்பதே நீங்களே கற்பனை செய்து பாருங்கள். எனவே புனித கடமைகளுக்கான சூழ்நிலையை உருவாக்க வேண்டியது சஊதி அரசாங்கத்தின் கடமை ஆகும். இவாறு உருவாக்க, சில இறுக்கமான சட்டங்களை இஸ்லாமிய வரையறைக்குள் உர்வாக்க வேண்டியது தவிர்க்க முடியாதது.

ReplyDeleteThis article writer intention is to protect Islamic value, but justifying Saudi and its Sharia Law is not acceptable. every body who working or worked in the past knew well about Saudis and the way they implementing Sharia law.they are biggest Sharia violators in the world. many Saudi house owners are using housemaids for their sexual purpose, when the housemaid put a complain police will not listen to them. in the road traffic violations, Saudi police not implementing Sharia Law or at least local law also. this particular sharia law against the woman to stone throw and kill for her illegal sex relation,the witter is saying that the Saudi environment is well set to remove opportunities for such wrong doing, first of all, the writer of this article should think about the woman and her situation which forced her to do illegal sex with another man due her because of her separation from legal husband for long period, as a Sharia implementing country like Saudi should not agree with woman recruitment taking away her from her husband and put her in the houses where men are living.so Sharia law is applicable in this case.

ReplyDeleteThe rule is not about a family being in power its about who implements the law if one family implements the sharia law a muslims duty is to obey to the law, not revolt against a government,
That said now lets discuss the current monarch, no ones saying that saudi family is gaining more than they asked for from their country yes they are corrupt yes they commit crimes, no arguments
But .... Without proper knowledge shouting kumbaya doesn't prove anything if u research u would find that the current number on beheadings combine both local and foreigners

The stoning women in Islamic law is a hot topic now days as a Sri Lankan women has been issued such verdict in Saudi under so called it’s Islamic law. Many comments here clearly illustrate the true nature of Saudi. Author of this article blatantly accepts everything practiced by Saudi rulers as Islamic way and laws. This women has committed a crime, everyone accept it. But this crime may not be considered for stoning her to death under the name of Islam.
ReplyDeleteAs I heard, there are no verses in the Quran which says to kill women by stoning her for adultery. There are Hadidhs which reports on one instance of such verdict issued by Prophet Muhammad (saws). Arabs mainly were practicing the Jaw’s laws in pre Islamic era such as beheading, stoning, amputations, etc. The same followed till the laws were changed by latest version introduced in the Quran.
There is very clear explanation about judgment to Adultery in Sura An-Nur (24:1). It says both woman and man should be punished with the hundred lashes
The direct meaning of Sura An-Nur (24:2):
“The adulterer and the adulteress, scourge ye each one of them (with) a hundred stripes. And let not pity for the twain withhold you from obedience to Allah, if ye believe in Allah and the Last Day. And let a party of believers witness their punishment.”
There is no very clear evidence whether the stoning incident reported in Hadidhts, was before the Sura An-Nur was delivered or after it.
Anyway many people translate Sura An-Nur (24:1) by adding women and man as an unmarried woman and an unmarried man by translating the Arabic adulterer as fornicator and adulteress as fornicatress, the unmarried people having illegal sex , to justify that the law mentioned in Quran is applicable only to unmarried woman or man.
Whatever the law, whether it is law of God or fabricated as of law of god, one thing is sure that sending our Sri Lankan women to strange places as housemaid without rightful guardian, is prohibited according to our faith, even if those country law permit them to keep other's women without a rightful guardian. It is not even advisable for other community in Srilanka, to send their women to abroad. Women has special place in our belief and in our culture. We cannot allow or should not make a place for some primitive people to torture, sexually abuse and unlawfully apply inhuman laws on our women.
Sri Lankan official will not make any right decision on this regard as the government is only looking for foreign currency by selling anything and the Crocodiles agencies have much influence in the government. And also, suddenly stopping sending the women abroad, will affect many ordinary families economically. Authorities should look into the ways to improve the economical level of poor people. Social organization, aid workers and other religious & none religious organizations may play a major role in arranging self employments at home, organizing awareness programs and educating the people to prevent the women going abroad as housemaid.
If anyone commits sin, that person must be penalized under the purview of Islam. The nationality has no bearing on this and thus no matter whether he/she a Saudi or any others. Everyone is liable for his/her deed.
ReplyDeleteMeantime if you are an offender, you cannot abscond from the punishment on the back of other culprits. It's gross ignorance and undue.Whether they get the sentence or not you must obey to the law. Persons who criticize the Saudi's law at their stupidity should realize and perceive this.
